Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Customer") and NextGenHost ("NextGenHost," "we," "us," or "our"), governing your access to and use of NextGenHost's website, dashboard, and hosting services (collectively, the "Service") available at https://nextgenhost.cc. By creating an account, topping up your wallet, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
NextGenHost provides on-demand, prepaid Minecraft game server hosting billed at a flat rate per GB of RAM per hour, with no subscriptions. When you deploy a server, we provision a dedicated, containerized Minecraft server instance for a rental period you select (any length from 30 minutes up to 30 days per deployment, in 30-minute increments, subject to your available balance), which you may extend at any time by spending additional wallet balance before it expires. Selecting the full 30-day length — whether when deploying or when extending — receives an automatic 46% discount off the flat rate above; every other length is billed at the flat rate with no discount. You are responsible for configuring, moderating, and operating the game world you deploy, including any plugins, mods, or player-management decisions you make through the dashboard.
The Service also includes an optional plugin/mod marketplace that lets you search and install content sourced from third-party repositories (such as Modrinth, CurseForge, and Hangar) or submitted by other users of the platform. Community-submitted marketplace items go through an internal review step before publication, but we do not guarantee the safety, quality, or licensing compliance of any third-party or community-submitted content, and you install it at your own risk.
Features described on our pricing or marketing pages that are not yet available for purchase or deployment through the dashboard are not part of the Service until they are actually offered at checkout.
2. Accounts and Eligibility
You must provide accurate registration information and keep your password confidential. You are responsible for all activity that occurs under your account, including actions taken by anyone you allow to access it. You must be legally capable of entering into a binding contract in your jurisdiction to use the Service. If you believe your account has been compromised, change your password immediately and contact us (see Section 12).
3. Payments and Wallet Balance
The Service is prepaid. You add funds to an in-account wallet, denominated in Thai Baht (฿), using the payment methods we make available from time to time (currently PromptPay via Stripe, and admin-reviewed manual bank transfer). Wallet balance is deducted automatically as you deploy or extend servers, based on the RAM tier and rental duration you select at the time of the transaction. All prices are shown in Thai Baht and are subject to change; a price change never affects a purchase you already completed.
Wallet balance has no cash value outside the Service, is non-transferable between accounts, and does not expire solely due to the passage of time, though your account itself may become inactive per Section 6. Refunds are governed separately by our Refund Policy, which forms part of these Terms.
4. Your Responsibilities
You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy, which forms part of these Terms. You are solely responsible for the content, configuration, plugins, mods, and player conduct on any server you operate. You must not attempt to access another customer's server, account, or data, or attempt to circumvent resource limits, billing, or security controls of the Service.
5. Abuse, Suspension, and Termination
We may suspend or terminate your account or any server, without prior notice, if we reasonably believe you have violated these Terms or our Acceptable Use Policy, engaged in fraud or chargeback abuse, placed excessive load on shared infrastructure, or otherwise put the Service, other customers, or third parties at risk. Where practical, we will attempt to notify you of the reason for suspension and any steps available to resolve it.
You may stop using the Service and delete your servers at any time from the dashboard. Deleting a server is permanent — see Section 7 (Backups) before doing so. We may also discontinue the Service, in whole or in part, with reasonable notice where practical, except where immediate action is required for security, legal, or operational reasons.
6. Account Inactivity
If your account has no active servers and no wallet activity for an extended period, we may treat it as inactive for operational purposes (for example, excluding it from certain notifications). Inactivity alone does not forfeit any wallet balance you hold.
7. Backups and Data Loss
Minecraft world data lives inside your server's container for the duration of its rental. Deleting a server, or letting a server's rental period expire without extending it, permanently destroys that server's world data. The dashboard provides a manual backup tool — use it before deleting or letting a server expire if you want to keep your world. We are not responsible for world data lost because a backup was not taken before deletion or expiry. We perform our own operational backups of platform infrastructure (accounts, wallet/transaction records, and configuration) for disaster-recovery purposes, but these are not a substitute for taking your own in-dashboard world backup, and we do not guarantee recovery of any individual customer's world data from them.
8. Availability
We work to keep the Service available and performant, and you can check real-time platform status at our status page. However, the Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation, and we are not liable for downtime caused by maintenance, third-party infrastructure or payment-provider outages, force majeure events, or factors outside our reasonable control. Scheduled maintenance will be communicated via the status page where practical.
9. Intellectual Property
The NextGenHost name, logo, website, and dashboard software are owned by us or our licensors and are protected by intellectual property law. These Terms do not grant you any right to use our branding except as necessary to use the Service as intended. You retain ownership of any content you upload or configure on your own server (world data, plugin configuration, avatar images, and similar), and you grant us only the limited right to store, process, and transmit that content as necessary to operate the Service for you. Minecraft is a trademark of Mojang Synergies AB / Microsoft; NextGenHost is not affiliated with, endorsed by, or sponsored by Mojang or Microsoft.
10. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, NextGenHost and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, world content, profits, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.
11. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles, and any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Thailand, unless applicable consumer-protection law in your jurisdiction requires otherwise.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where practical, provide notice through the dashboard or another reasonable channel. Continuing to use the Service after a change takes effect constitutes acceptance of the revised Terms.
